These terms and conditions cover our general terms and conditions, followed by our Bristol Living Soil Project memberships, Living Soil product, and our other shop items.

You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Use of Our Website and Services
6. Eligibility: You must be 18 years or older to use our website or services. If you are under 18 years of age, you must obtain parental or legal guardian consent.

11. Return Policy: By placing an order with Generation Soil CIC, you agree to our return policy as outlined on our website. You acknowledge that you have read and understood the terms of our return policy, including the eligibility requirements, time frames, and return procedures. You agree to comply with our return policy and to bear all associated costs, for any returns that you request. Generation Soil CIC reserves the right to refuse a return that does not meet our eligibility requirements or that is requested outside of our designated time frame.
Disclaimers and Limitation of Liability
12. Disclaimer of Warranties: Our website and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability: In no event shall Generation Soil CIC be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our website or services. This limitation of liability shall apply to the fullest extent permitted by law.

Termination
17. We may terminate your access to our website or services at any time and for any reason without notice to you. You may also terminate this Agreement at any time by ceasing to use our website and services.
Governing Law and Jurisdiction
18. This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the United Kingdom.
Entire Agreement
19. This Agreement, along with our privacy policy, constitutes the entire agreement between you and Generation Soil CIC with respect to your use of our website and services, and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Generation Soil CIC.
Severability
20. If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver
21. The failure of Generation Soil CIC to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.
Bristol Living Soil Project Membership
22. Our memberships are either £5, £10, or £15 per month. This includes provision of clean sealable buckets, bokashi bran top ups, food waste collections, and the delivery of Generation Soil Living Compost in accordance with what is stated on the membership options.
23. If you do want to cancel your subscription, use the membership portal on our website or drop us an email and we’ll get it sorted.
24. If you ever have a problem or a question, please get in touch via email (alex@generationsoil.co.uk) and we’ll do our best to help you.
25. We really want our customers to have a top experience. Reducing your food waste and improving your soil health can be rewarding, therapeutic, healthy and environmentally friendly - to name a few. If your experience isn’t a happy one, please get in touch and we’ll try to make it better.
26. We try to make collecting your food waste and using your Living Compost as easy as possible, with simple guides and how-to videos. That being said, some things are out of our control, like unexpected conditions and the way people follow our instructions. Because of that, we’re not responsible for the ultimate success of your experience.
27. After we drop your buckets off to you, we're not responsible for anything that happens involving its contents.
28. Generation Soil payments are taken when you make your first payment, then repeat on the same day of each month.
29. We sometimes offer discount codes. Each delivery address can only use a discount code once - and we reserve the right to close your account if you try to take the mick.
30. Our deliveries come through our own drivers. We will communicate with you to update you of any changes to our normal service.
31. The value of Living Compost you request cannot (unless otherwise agreed - see item 32 below) exceed the actual amount of monthly membership payments you have made to us. If you'd like an additional quantity of Living Compost that exceeds the aggregate value of your monthly membership payments then please check our FAQs or get in contact with us to discuss options.
32. If we agree to provide you Living Compost beyond the aggregate value of your monthly membership payments, we will either:
a. Require you to pay an amount upfront, commensurate to the amount of Living Compost you have requested above the aggregate value of the actual monthly membership payments you have made. Or
b. Allow you to continue making the same monthly membership payments associated with your chosen plan, save that, should you cancel your membership and the amount of Living Compost provided to you exceeds the aggregate value of the actual monthly membership payments you have made, you agree to pay a cancellation fee. This fee shall be an amount equivalent to the difference between the aggregate value of the actual monthly membership payments which you have made on the cancellation date, and the list value of the Living Compost which you have received.
Living Soil
Additional Products
13. We also provide products that can be purchased on a one-off basis on our website. These products or services may have limited quantities and are subject to return or exchange only according to our Returns Policy.
14. We try out best to display the colours and images of our products that appear on our website. We can't guarantee that your computer or phone will display these colours accurately.
15. We reserve the right to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
16. Our deliveries come through a mixture of our own drivers and Royal Mail - it depends on the delivery location and how busy we are. As standard, your box should arrive 2-3 working days after you place your order.
