These terms and conditions cover our general terms and conditions, followed by our Bristol Living Soil Project memberships, Living Soil product, and our other shop items.
General Terms and Conditions
1. Introduction: These terms and conditions (the “Agreement”) constitute a legal agreement between you and Generation Soil CIC.
2. Acceptance of Terms: By accessing or using our website or services, you agree to be bound by these terms and conditions. If you do not agree to these terms, you should not use our website or services.
3. Modification of Terms: We reserve the right to modify or update these terms and conditions at any time without prior notice to you. Your continued use of our website or services after any such changes shall constitute your acceptance of such changes.
4. Electronic Communications: By using our website or services, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Use of Our Website and Services
6. Eligibility: You must be 18 years or older to use our website or services. If you are under 18 years of age, you must obtain parental or legal guardian consent.

Payment, Invoicing, and Return Policy

11. Return Policy: By placing an order with Generation Soil CIC, you agree to our return policy as outlined on our website. You acknowledge that you have read and understood the terms of our return policy, including the eligibility requirements, time frames, and return procedures. You agree to comply with our return policy and to bear all associated costs, for any returns that you request. Generation Soil CIC reserves the right to refuse a return that does not meet our eligibility requirements or that is requested outside of our designated time frame.
Disclaimers and Limitation of Liability
12. Disclaimer of Warranties: Our website and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability: In no event shall Generation Soil CIC be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our website or services. This limitation of liability shall apply to the fullest extent permitted by law.
Intellectual Property
14. Ownership: Generation Soil CIC owns all rights, title, and interest in and to our website and services, including but not limited to all intellectual property rights.

Indemnification

You agree to indemnify, defend, and hold harmless Generation Soil CIC, its officers, directors, employees, and agents from any and all claims, damages, expenses, or other losses arising out of or in connection with your use of our website or services, including but not limited to any violation of these terms and conditions or any infringement of any intellectual property or other right of any person or entity.
Termination
17. We may terminate your access to our website or services at any time and for any reason without notice to you. You may also terminate this Agreement at any time by ceasing to use our website and services.
Governing Law and Jurisdiction
18. This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the United Kingdom.
Entire Agreement
19. This Agreement, along with our privacy policy, constitutes the entire agreement between you and Generation Soil CIC with respect to your use of our website and services, and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Generation Soil CIC.
Severability
20. If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver
21. The failure of Generation Soil CIC to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.
Bristol Living Soil Project Membership
22. Membership tiers and pricing are as follows:
Soil Supporter: £5/month Food waste is collected and composted locally. You contribute to the Bristol Living Compost Project without receiving compost back.
Soil Saint: £10/month 60 litres of living compost allocated per membership year, plus food waste collections on request.
Soil Saviour: £15/month 100 litres of living compost allocated per membership year, plus food waste collections on request.
All memberships include provision of clean sealable bokashi buckets, bokashi bran top-ups as needed, and food waste collections on request. No contracts. Cancel anytime.
23. Your compost balance accrues over time from the start of your membership period. The rate of accrual depends on your membership tier. Your current compost balance is visible at any time through the member portal.
24. Compost can be requested through the member portal once your balance is sufficient. We will arrange delivery at the next available opportunity. Compost balances cannot be exchanged for cash and have no monetary value outside of the membership system.
25. If you would like additional compost beyond your annual allocation, additional quantities are available to purchase through the member portal or by contacting us directly.
26. Food waste collections are on request. To request a collection, use the member portal or contact us directly. We operate collection routes across BS1 to BS9. Collections outside these postcodes are not currently available.
27. Payment is taken on the date you first subscribe and repeats on the same date each month. Payments are processed securely through Stripe. You will receive a receipt by email for each payment.
28. To cancel your membership, log into the member portal at members.generationsoil.co.uk or contact us at hello@generationsoil.co.uk. Cancellations take effect at the end of your current billing period. Any unused compost balance is forfeited on cancellation.
29. We sometimes offer discount codes and promotional offers. Each membership account can only use a discount code once. We reserve the right to suspend accounts where promotional offers are misused.
30. If you opt in to WhatsApp communications at the point of signup, we will send you collection reminders and service updates via WhatsApp. You can opt out at any time by contacting us.
31. Referral scheme: if you refer a friend who becomes a paying member using your unique referral code, you will receive 20 litres of living compost added to your balance. Referral rewards are added once the referred member's first payment is confirmed. Generation Soil CIC reserves the right to modify or withdraw the referral scheme at any time.
32. Collections take place on Mondays, or Tuesdays on bank holidays. We will communicate any changes to the normal collection schedule in advance.
33. After we collect your bucket, we are not responsible for anything that happens involving its contents during processing beyond our standard composting practices.
34. We make every effort to ensure a great experience. If you have any questions or concerns, please contact us at hello@generationsoil.co.uk and we will do our best to help.
35. If you have a complaint about our service, please contact us in the first instance at hello@generationsoil.co.uk. We will acknowledge your complaint within 5 working days and aim to resolve it within 28 days.
Living Soil
36. Living Soil products are available to purchase on a one-off basis through our website or member portal. Quantities are subject to availability. Delivery is arranged through our own drivers across Bristol. We will contact you to confirm delivery timing.
Additional Products
37. We also provide products that can be purchased on a one-off basis on our website. These products or services may have limited quantities and are subject to return or exchange only according to our Returns Policy.
38. We try out best to display the colours and images of our products that appear on our website. We can't guarantee that your computer or phone will display these colours accurately.
39. We reserve the right to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
40. Our deliveries come through a mixture of our own drivers and Royal Mail - it depends on the delivery location and how busy we are. As standard, your box should arrive 2-3 working days after you place your order.
Additional bits and bobs
41. We are a small social enterprise, and we appreciate your patience and understanding.
42. All content on our website and in our communications is the intellectual property of Generation Soil CIC. You may not reproduce or distribute our materials without our express written permission.
